WIPO Performances and Phonograms Treaty (WPPT)
The WIPO Performances and Phonograms Treaty (WPPT) is a significant international agreement that extends protection to the rights of performers and phonogram producers, particularly in the digital environment.
Performers are granted exclusive rights over their performances, including the rights of reproduction, distribution, rental, and making their performances available to the public (e.g., via the internet). This means they have the authority to authorise or prohibit the copying, selling, lending, or online access to their recorded performances.
The WPPT also recognises moral rights for performers. This ensures that performers have the right to be identified as the performer of their performances (right of attribution) and to object to any distortion, mutilation, or other modification of their performances that would be prejudicial to their reputation (right of integrity). These rights remain with the performer even after the economic rights may have been transferred.
Producers of phonograms (sound recordings) are also granted similar economic rights, encompassing reproduction, distribution, rental, and the right to make their phonograms available to the public.
