7 Steps of the Patent Registration Process in the UAE

The UAE patent process moves through seven stages. Abou Naja IP manages each stage and tracks every statutory deadline.

1. Pre-Application: Prior Art Search and Patentability Assessment

A prior art search across patent and non-patent databases establishes whether the invention is novel and inventive before any costs are committed. Abou Naja IP uses this assessment to refine the scope of protection and identify risks early.

2. Patent Drafting: Specification, Claims, and Drawings

Abou Naja IP prepares the full specification, claims, abstract, and technical drawings. Each claim must be precisely worded, limited in scope to what the specification discloses, and drafted without ambiguity.

3. Filing the Application With the Ministry of Economy

The application is filed electronically in Arabic and English. Where Paris Convention priority is claimed, filing must occur within 12 months of the first foreign application.

4. Formal and Legal Examination

The Ministry reviews the application and issues a notice of acceptance alongside a request for the examination fee, payable within 90 days.

5. Substantive Examination

The Korean Intellectual Property Office assesses novelty, inventive step, and industrial applicability on behalf of the UAE. Abou Naja IP responds to any objections raised. Expedited examination delivers a report in approximately six months.

6. Publication

Once the invention passes substantive examination, the publication fee is paid, and the patent is published, placing third parties on notice of the rights.

7. Grant and Certificate Issuance

The patent is registered, and the Ministry issues the certificate. The invention is protected in the UAE for 20 years from the filing date, subject to annual renewal fees.

Documents Required

To register a patent in the UAE, you will need:

  • Power of Attorney – notarised, in Arabic or in English and Arabic. Legalization is not required. Due within 90 days of filing.
  • Certificate of Incorporation or Commercial Register extract – notarised, with Arabic translation, where the applicant is a company.
  • Deed of Assignment – signed by both parties and notarised, where the applicant is not the inventor.
  • Certified copy of the priority document – with Arabic and English translations, if priority is claimed. Due within 90 days of filing.
  • Specification, claims, abstract, and drawings – in Arabic and English.

Several supporting documents can be submitted within 90 days of the filing date, so the filing date can be secured quickly and paperwork finalized shortly after.

Cost and Timeline

Total cost depends on the applicant type, the number of claims, translation requirements, official search and examination fees, and agent fees. Official fees are set by the Ministry of Economy and paid electronically. Indicative figures:

  • Government filing fee (Natural persons, SMEs, academia): From AED 1,000
  • Government filing fee (Legal persons/Companies): From AED 2,000
  • Formality fee (All applicants): AED 400

What Can Be Patented in the UAE?

To qualify for patent filing in the UAE, an invention must meet three conditions under Federal Law No. 11 of 2021:

  • Novelty – the invention must be new anywhere in the world and not disclosed to the public before the filing or priority date. A 12-month grace period applies to disclosures made by the inventor.
  • Inventive step –  An individual with standard expertise in the relevant technical field must not find the invention obvious at the time of filing
  • Industrial applicability – the invention must be capable of being made or used in any industry.

Products, devices, chemical compositions, processes, and methods of manufacture that meet these tests can be protected. An invention that is new and useful but has a lower inventive step may instead qualify for a utility model, which lasts up to 10 years.

What Cannot Be Patented?

UAE patent law excludes the following:

  • Plant and animal species, and essentially biological processes for producing them, except microbiological methods and their products.
  • Methods of diagnosis, treatment, and surgery for humans or animals.
  • Discoveries, scientific theories, principles, and mathematical methods.
  • Schemes, rules, and methods for doing business, performing mental acts, or playing games, and computer programs as such.
  • Natural materials purified or isolated from nature, though methods of isolating or purifying them may qualify.
  • Inventions whose commercial use would conflict with public policy, undermine moral standards, or cause harm to human life, animal welfare, or the environment.

Legal Framework Governing UAE Patents

Patent registration in the UAE is governed by Federal Law No. 11 of 2021 on the Regulation and Protection of Industrial Property Rights and its implementing regulation, Cabinet Decision No. 6 of 2022. These align the UAE system with the Paris Convention and the Patent Cooperation Treaty (PCT).

The UAE Ministry of Economy receives, examines, and grants patents across all seven emirates, including the free zones. Applications and fees are handled through the Ministry's online portal. Foreign applicants must be represented by a patent agent registered in the UAE.

UAE National Patent vs GCC Patent

The GCC Patent Office stopped accepting new applications in January 2021, making the national route through the UAE Ministry of Economy the only path to patent protection in the UAE. Filing separate national applications in each country is now essential for Gulf-wide coverage.

Patent Protection Duration and Renewal

UAE patents are protected for 20 years from filing. Annual renewal fees begin the year after filing. Submit renewal requests within three months before each due date, with a three-month grace period available without surcharge. Late payment with surcharge is possible.

If annuities lapse after the grace period, the patent lapses, though restoration is available with fee payment. Abou Naja manages docketing and pays renewals to prevent accidental lapse. Utility model protection lasts a maximum of 10 years from filing.
