Madrid Protocol

The Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks, adopted in 1989, was a response to the limitations and inflexibilities of the original Madrid Agreement (1891).

The countries and organisations participating in the Madrid System are collectively known as Contracting Parties. This system enables trademark holders to secure protection for their marks across multiple jurisdictions through a single international registration, which is valid in each designated Contracting Party.

An international application for a mark can only be filed if the mark has already been registered with the trademark office of the relevant Contracting Party to which the applicant is connected—known as the office of origin. The international application may also be based on a pending application filed with the office of origin.
