Trademark Registration in the Philippines

A Philippine trademark registration grants exclusive rights to use a brand name, logo, or slogan for specific goods and services across the country. Issued by the Intellectual Property Office of the Philippines (IPOPHL), a registration lasts 10 years and can be renewed every 10 years, provided the owner submits proof of use on schedule.

Operating since 1971 and an active member of the International Trademark Association (INTA), Abou Naja IP represents local businesses, global brands, and foreign law firms as their local agent. We manage the process from clearance search to registration and maintenance.

Why Register Your Trademark in the Philippines?

  • First-to-File Protection: The first party to file gets the rights. Filing early stops competitors or former distributors from taking your name.
  • Exclusive Rights: Registration grants sole ownership to use the mark across the country for your listed goods and services.
  • Stop Counterfeits: A registered mark allows border seizures by customs and supports takedown requests on marketplaces like Shopee and Lazada.
  • Commercial Asset: A registration allows you to license, franchise, or sell the brand to partners and investors.

الأسئلة الشائعة

01

How much does trademark registration cost in the Philippines?

Official IPOPHL fees start at PHP 2,670 for a small entity and PHP 4,752 for a big entity for one class. This covers the application, publication, and registration certificate fees, plus the 1% Legal Research Fund. Additional classes require extra fees. Abou Naja IP charges a single fixed professional fee.

02

How long does it take to register a trademark in the Philippines?

A smooth application takes 8 to 12 months. If the examiner raises objections or a third party files an opposition, the process takes longer.

03

Can a foreign company register a trademark in the Philippines?

Yes. Foreign individuals and businesses can register directly with IPOPHL or through the Madrid System. Foreign applicants must hire an authorized Philippine resident agent to handle filings and official mail.

04

Do I need to visit the Philippines to file?

No. All filings are submitted online through IPOPHL's eTMfile portal. You only need to provide mark files, business details, and a signed Power of Attorney.

05

Does an SEC or DTI registration protect my trademark?

No. SEC registration reserves a corporate name, and DTI registration reserves a business name. Neither grants exclusive rights to use a brand on products or services. Only an IPOPHL trademark registration gives you nationwide legal protection.

06

What is a Declaration of Actual Use (DAU)?

A DAU is a sworn document showing that you use your trademark commercially in the Philippines. You must submit physical or digital evidence, such as product labels or sales receipts. DAUs are due 3 years after filing, between the 5th and 6th years of registration, at renewal, and 5 years after renewal. Missing a DAU cancels the trademark.

07

What if someone already filed my brand?

You can file an opposition within 30 days of the mark's publication in the e-Gazette. If the mark is already registered, you can file a petition for cancellation within 5 years, or at any time if filed in bad faith or left unused for 3 consecutive years.

08

Can I include multiple classes in one application?

Yes. The Philippines accepts multi-class applications. Official filing fees and DAU fees apply per class.
