Power of Attorney

Protection Term:

Trademark registrations are valid for 10 years from filing date and are renewable for like periods. There is a grace period of 6 months for late renewals with payment of a surcharge.

Classification:

The International Classification of Goods and Services (10th Edition) is followed. A separate application is required for each class.

Opposition:

Oppositions may be filed within 90 days from publication date and extension of time is possible.

Power of Attorney:

General Power of attorney is sufficient for continuous application.

Use Requirements:

Use of a trademark is not required for registration or renewal of a mark. However, a trademark is vulnerable to cancellation by any interested party if there has been no effective use of the mark for a period of 3 consecutive years from registration date.

Assignment:

Trademarks may be assigned with or without the goodwill of the business concerned and May be recorded for registrations only.

License:

License recordation is not compulsory to be effective against third parties and May be recorded for registrations only.

Merger:

May be recorded for registered marks.

Change of Name/Address:

May be recorded for applications and registreations.

Time Frame:

Conducting search is between 3 to 5 working days, Registration/Renewal process is within 09 to 18 months and Recordation process within 08 to 12 months.

  • Power of Attorney Apostilled or duly legalized up to Oman consulate.
  • Simple copy of Certificate of incorporation or Extract from the Commercial register.
  • A priority document if priority is to be claimed.

Renewal:

  • Power of Attorney Apostilled or duly legalized up to Oman consulate (in case we are not the agents of record).

Assignment:

  • Power of Attorney signed by the assignee Apostilled or duly legalized up to Oman consulate.
  • Deed of assignment executed by both parties Apostilled or duly legalized as above.
  • Simple copy of Certificate of incorporation or Extract from the Commercial register.

License:

  • Power of Attorney signed by the licensee Apostilled or duly legalized up to Oman consulate.
  • License agreement indicating the trademark registration number Apostilled or duly legalized as above.
  • Simple copy of Certificate of incorporation or Extract from the Commercial register.

Merger:

  • Power of Attorney Apostilled or duly legalized up to Oman consulate.
  • Certificate of merger indicating the trademark registration number Apostilled or duly legalized as above.
  • Simple copy of Certificate of incorporation or Extract from the Commercial register.

Change of Name/Address:

  • Power of Attorney in the new name/address Aposttiled or duly legalized up to Oman consulate.

Protection Term:

The term of protection is 20 years from international filing date.

Annuities:

Due annually on the anniversary of the international filing date and payable prior to grant. 6-month grace period for late payment with a surcharge.

Opposition:

Patents are published in the Official Gazette after substantive examination and before grant; oppositions may be filed within 120 days from publication. The patent is re-published after grant but no opposition period is provisioned then.

Search:

Patent applications and patents may be searched by title and patentee name

Examination:

As to form, novelty, inventiveness, industrial applicability, unity and compliance.

Compulsory License:

A patent has to be worked; within 3 years from grant date. The patent may be subject to compulsory licensing according to the provisions in the law.

Novelty Requirements:

Absolute novelty is required.

Applications with Multiple Figures:

Admissible up to 100 designs provided that all these designs belong to the same class in international specifications.

Remark:

The Omani Patent Office is now accepting design applications. However, it is important to note that the Omani Intellectual Property Department is yet to disclose specific formalities regarding requirements, examination, publication, registration and renewal.
